Paws Intuition Terms and Conditions

Dogs are sentient beings whose emotions and behaviours naturally change over time due to factors such as age, health, relationship, and changes in their environment. Any guarantee in these Terms and Conditions cannot circumvent these factors.

1. Definition

- Agreement means the quotation, acceptance, and the following terms and conditions.

- Work or Works means behaviour consultation, training, handouts, written reports, behaviour programs, and training programs created by Paws Intuition. It may also include other services such as administrative tasks, training meetings, and other necessary tasks.

- Paws Intuition extends to the name Leanne Carmichael.

- Client means the individual who requested the work.

- Amendments means any alteration to the work.

2. Entire Agreement

- These terms and conditions apply to all sales and services by Paws Intuition, to the exclusion of any other terms unless otherwise agreed in writing.

- Paws Intuition reserves the right to update these Terms and Conditions at any time by notice and with immediate effect.

- These terms and conditions shall prevail over all terms and conditions of customary practice or any previous course of dealings the client has had with Paws Intuition.

- These terms and conditions shall be subject to English Law.

- The contents of the quotation (verbal or written) and these Terms and Conditions form the agreement between Paws Intuition and the Client relating to the work. No variation of them will be binding unless agreed in writing and signed by Paws Intuition.

- Each clause of this Agreement is independent and operates separately in its own right.

- By agreeing to these terms and conditions, your statutory rights are not affected.

- Should Paws Intuition decide to waive any of these terms on an individual basis, this shall not affect the validity of the remaining clauses or commit Paws Intuition to waive the same clause on any other occasion.

- Any alterations or variations of these terms and conditions shall be inapplicable unless agreed in writing by all parties concerned before commencement of any work.

- Ordering services or using work created by Paws Intuition automatically means agreeing to these terms and conditions.

- This contract shall be governed by the laws of England, and both parties shall submit to the non-exclusive jurisdiction of the English courts.

3. Guarantee

- Paws Intuition shall create the agreed work for the use of the client.

- The client may use the work or works only in its original form and only for its original use for the animal named and described within the work.

- Behaviour work cannot be guaranteed with any animal.

- Paws Intuition shall create behaviour and training programmes to the specifications of the problems assessed at the first training session or consultation and will make amendments to the training and behaviour programme accordingly.

- The training and behaviour programme is specific to the dog(s) that the programme has been designed for and should not be used in part or whole with any third party.

- The client shall agree not to sell, destroy, deface, alter, or part with work created by Paws Intuition or permit it to be given or done so by any third party.

4. General

- Work created by Paws Intuition is charged to the client at the agreed amount.

- All work created by Paws Intuition for the client is to be used for the sole purpose for which it was created.

- The client does not have the right to resell work created by Paws Intuition or repurpose it without written consent from Paws Intuition.

- Paws Intuition will not be responsible for the creation of work that in any way contravenes any existing Legislation and in particular the Trade Description Act 1968 and the Consumer Credit Act 1974.

- Paws Intuition reserves the right to refuse to provide service or create work at its own discretion.

- All amendments must be agreed upon by both Paws Intuition and the client.

5. Payment

- The client shall pay Paws Intuition the full price of the service prior to the first consultation/training session/class as agreed upon booking.

- Paws Intuition expects payment in full by electronic bank transfer, cash, or via card payment where available.

- While outstanding payment is due, Paws Intuition reserves the right to withhold the designs, services, or goods.

- Any payment returned by the bank or card company will incur a £10 admin charge as well as any charges made by the bank.

- In case collection proves necessary, the client agrees to pay all fees (including all legal fees and court costs) incurred by that process.

- If for any reason whatsoever Paws Intuition is unable to provide an agreed product or service in accordance with these terms and conditions, our liability shall be limited in its entirety to a proportional refund of any fees paid by you for the service or product.

- All administrative fees to third parties and the time taken to organise will be charged to the client irrespective of any quoted amount set out in the quotation with its specifications.

6. Cancellation and Refunds

- Paws Intuition may terminate any agreement at its discretion:

- If the client fails to pay which has become overdue.

- If the client breaches any of the terms of the agreement.

- If Paws Intuition discovers that the client’s use of work produced is unethical, misleading, or morally corrupt.

- If the client’s use is in any way harmful to Paws Intuition or its reputation.

- The client may cancel the agreement at any time but may be invoiced up to the full amount quoted based on the degree to which the work has been completed and on the extent to which time has been allocated to the project that cannot be effectively used to generate revenue that would otherwise be lost.

- A service will be deemed as cancelled if there is more than 30 days from the first training or consultation.

- 1-2-1 sessions require a minimum of 72 hours’ notice of cancellation and can be transferred to another date subject to availability.

- Any cancellations with less than 72 hours' notice will be charged at full price and will not be rescheduled unless in exceptional circumstances and agreed upon by Paws Intuition.

- No refunds will be issued unless in exceptional circumstances and agreed upon by Paws Intuition. All bookings include a £50 non refundable booking fee.

7. Paws Intuition’s Liability

- Paws Intuition shall have no liability under any circumstance whatsoever to the client for financial loss or loss of profit.

- Paws Intuition will not be held responsible under any circumstances whatsoever to the Client for a lack of time, effort, and circumstances from the work.

- In no event will Paws Intuition be liable to the client or any third party for damages or losses.

- Paws Intuition will not be liable for any loss, injury, or liability to the client. Handlers and/or owners remain responsible for their dogs at all times and are advised to ensure they have adequate pet or household insurance cover for liability in the unlikely event of damage or injury.

8. Copyright

- Paws Intuition holds copyright of all work created.

9. Advice

- The information and any treatment suggested consist of Paws Intuition’s personal views and are based on the information given to Paws Intuition by the client or person responsible for the animal(s) and/or Paws Intuition’s own conclusions resulting from personally gained evidence of the animal and the related behavioural problem.

- Treatment plans, for the most part, will not be successful overnight and require a good deal of patience.

- Paws Intuition cannot guarantee that this will work, as each animal is an individual case, nor is it possible to foresee if another problem may arise as a result of the treatment.

- All programs are specific to a certain animal and should not be tried on any other pet, only the animal whose name appears on the information.

- Paws Intuition encourages clients to contact their veterinary surgeon prior to putting the actions into effect if they are concerned.

- By booking one of Paws Intuition’s services, you agree to these Terms and Conditions.

- All aversive training equipment is banned, including but not limited to electric collars, spray collars, prong collars, rattle cans, and corrector spray. If you are unsure if you are using a banned item or would like further information on why these items are banned, please get in touch for a chat.

- Paws Intuition reserves the right to cancel or change an appointment at any time by notice with immediate effect, without cause.

- By booking, you agree to keep the date and time of the consultations/class.

11. Bookings

- A booking is not confirmed until payment has been received.

- No responsibility can be accepted by Paws Intuition for any injury to yourself or your dog, or any sickness or disease contracted while in the field, car park, or premises.

- Owners will not be permitted to use any piece of equipment in class unless the tutor is present, and they have been given guidance on how to use the equipment safely.

- All personal details are kept in confidence and will not be passed on to third parties for promotional use.

12. Digital Materials, Video Footage, and Photographs

- It is not appropriate to film instructors, other attendees, their families, or their puppies in any of our classes without their permission.

- There may be instances where the instructor will want to film or take photos for social media or the website, but in these instances, permission will be sought before any filming/photography is carried out, and prior notice given. You have the right to refuse to be filmed/photographed.

13. Equipment Hire

- All equipment hired out remains the

property of Paws Intuition.

- A refundable cash deposit will be required at the time of hire, for the full cost of replacement of equipment and will be refunded once equipment is returned to Paws Intuition in the same condition it was hired.

- Equipment is available to hire for a cost agreed by Paws Intuition, for use during the agreed period of training with Paws Intuition and must be returned upon completion of the agreed period.

- Should the client fail to return the agreed item at the agreed time or in a condition deemed unsuitable by Paws Intuition, then the deposit becomes non-refundable.

14. Training Classes/1-2-1 Training

- All dogs must be fit and healthy prior to attending each class or training session

- Occasionally, we may find that a class environment does not suit a dog or owner. Full discussion concerning the best way to proceed will be undertaken, and this may result in making alternative arrangements to assist you.

- We make every effort to ensure the safety of both clients and dogs during the training session.

- By making a booking, you accept that participating in an activity with dogs, children, and adults poses a risk of injury to yourself and your dog, and you agree to indemnify Paws Intuition for all personal injury and damage to property owned by you while attending the training classes.

- You also agree to make any person who accompanies you to the class aware that they do so at their own risk.

- We recommend that all dog owners have pet insurance including third party liability.

- Any missed classes due to reasons of yourself or your dog cannot be retaken at a later date unless agreed by the instructor at their discretion and dependent on availability and the age of the dog.

- 1-2-1 training can be rescheduled, but we require at least 72 hours’ notice.

15. Training Class / Premises Rules

- All dogs must remain on lead and kept away from contact with other dogs within the class unless specifically instructed by the instructor.

- All instances of accident or injury must be reported to the instructor at the time they occurred.

- Flexi leads are not permitted in class.

- The following items are NOT PERMITTED under any circumstances: choker chains and/or check chains of any description; electronic training collars, including citronella; any other device that causes discomfort, pain, or fear to the dog; prong or pinch collars; and any equipment that the trainer deems unacceptable.

- The use of physical force and punishment-based training techniques are not permitted. You will be given two warnings, then asked to leave and may be refused the right to attend further classes, and no refund will be given.

- Paws Intuition reserves the right to cancel classes or training sessions should they deem necessary. In such a case, the class will be rescheduled.

- Our classes may be held in an outdoor setting, and we cannot be held responsible for adverse weather conditions. While we will continue to offer classes if the weather is unfavourable, extreme weather conditions may result in a class being postponed and rescheduled.

- Any children attending must be accompanied by an adult and must remain under control at all times. If this is not possible, then you may be asked to leave.

- Children are not permitted to hold the lead unless directed by the instructor.

- No more than two people per puppy may attend puppy class, including any children.

16. Offers, Discounts, and Prize Draws

- Paws Intuition may offer discounts or price reductions on services. Please note that offers are not available to use in conjunction with any services already discounted.

- Any client leaving a review will be entered into the end-of-year prize draw.

- The prize draw will be conducted at the end of the year, and the winner will be chosen at random.

18. Events

- Any tickets purchased for single events are non-refundable. In the event that the event itself gets cancelled, a full refund will be offered.
